c. Exceptions

The obligations of confidentiality shall not apply to information that is:

i. Publicly available or becomes publicly available through no fault of the recipient;

ii. Independently developed by the recipient without reference to the Confidential Information;

iii. Rightfully obtained from a third party without restriction on disclosure.

3. Termination

We reserve the right to terminate or suspend access to our service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

4. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, Florida, without regard to its conflict of law provisions.

5. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time.

6. Disclaimer of Liability

a. No Warranty

Getaway Technologies LLC provides the service on an "as-is" and "as-available" basis. We make no representations or warranties of any kind, express or implied, regarding the use or the results of this service in terms of its correctness, accuracy, reliability, or otherwise.

b. Assumption of Risk

By using Getaway Technologies LLC, you acknowledge and agree that any use of the service is at your own risk. You assume full responsibility for all risks associated with your use of the service.

c. No Liability for Damages

To the fullest extent permitted by applicable law, Getaway Technologies LLC, its affiliates, officers, directors, employees, agents, and licensors shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses, resulting from:

i. The use or inability to use the service;

ii. Unauthorized access to or use of our servers and/or any personal information stored therein;

iii. Any interruption or cessation of transmission to or from the service;

iv. Any bugs, viruses, trojan horses, or the like that may be transmitted to or through the service by any third party;

v. Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the service.

d. Limitation of Liability

In no event shall Getaway Technologies LLC be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from

(a) your use or inability to use the service;

(b) any unauthorized access to or use of our servers and/or any personal information stored therein;

(c) any interruption or cessation of transmission to or from the service;

(d) any bugs, viruses, trojan horses, or the like that may be transmitted to or through the service by any third party.

e. Exceptions

Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the limitations set forth above may not apply to you.
